Terms of Service

These Terms of Service (“Terms”) govern your use of the Mystic Visions app (“App”) and website (“Site”), operated by Foobar Creative (“we”, “us”, “our”), an Australian business based in Adelaide, South Australia.

By downloading or using the App, you agree to these Terms. If you don’t agree, please don’t use the App.

1. Who Can Use Mystic Visions

You must be 18 years or older to use Mystic Visions. By using the App you confirm that you meet this requirement.

2. What Mystic Visions Does

Mystic Visions lets you chat with AI-powered mystics — including psychics, astrologers, tarot readers, oracles, and seers — to receive readings, guidance, and creative insights. Conversations are generated by artificial intelligence.

Mystic Visions is for entertainment purposes only. See section 9 below.

3. Your Conversations and Data — Where They Go

When you chat with a mystic in the App, your messages are sent to third-party AI service providers for processing in order to generate a response. We recommend you do not submit messages containing sensitive personal information — such as identification details, financial information, or anything you would not share with a third party.

How we collect, store, and use your information is described in our Privacy Policy, which forms part of these Terms.

4. Conversation Data Collection and Usage

In our ongoing efforts to improve Mystic Visions, we may collect and analyse conversation data from within the App. This data is used to improve the App’s functionality — such as enhancing the quality of readings, refining our AI, and developing new features. We handle conversation data with respect for your privacy and confidentiality, consistent with our Privacy Policy.

5. Your Account

Mystic Visions does not require you to create an account with a username or password. Information you enter in the welcome chat may be saved to personalise your experience and is tied to your device.

If you uninstall the App, any data tied to your device may be permanently lost.

6. Subscriptions and Purchases

Mystic Visions offers a subscription (“Mystic Visions Premium”) to unlock additional readings and features. A free trial may be available for new users.

  • Purchases are billed through Apple’s App Store. Apple handles all payment processing.
  • You can manage or cancel a subscription at any time through your Apple ID settings.
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
  • We do not offer refunds directly — refund requests must be made through Apple.
  • Free trials convert to a paid subscription at the end of the trial period unless cancelled beforehand.

7. Intellectual Property

We are the owner or licensee of all intellectual property rights in the App and Site, including the source code, software, designs, text, graphics, logos, and trademarks (the “Content”). The Content is provided for your personal, non-commercial use only.

Subject to your compliance with these Terms, we grant you a non-exclusive, non-transferable, revocable licence to access and use the App for your personal, non-commercial use. You may not copy, reproduce, republish, distribute, sell, or otherwise commercially exploit any part of the App or its Content without our prior written permission. We reserve all rights not expressly granted to you.

8. Acceptable Use

You agree not to use Mystic Visions to:

  • Generate content that is defamatory, harassing, hateful, offensive, or unlawful
  • Submit information about another person without their consent
  • Systematically retrieve, scrape, or harvest data from the App or Site
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App, except as permitted by law
  • Use any automated system (bots, scripts, spiders, scrapers) to access the App
  • Interfere with, disrupt, or place an undue burden on the App or its supporting infrastructure
  • Circumvent, disable, or interfere with subscription restrictions, security features, or access controls
  • Use the App for any revenue-generating endeavour or commercial enterprise

9. Entertainment Purposes Only

Mystic Visions is provided strictly for entertainment purposes only. The readings, guidance, and other content generated by the App are creative and artistic interpretations produced by artificial intelligence. They are not based on scientific principles and are not factual predictions.

Do not rely on content from the App for medical, legal, financial, psychological, relationship, or other important decisions. You should consult an appropriately qualified professional for advice tailored to your situation. AI outputs are not guaranteed to be accurate, reliable, suitable, or complete. Any reliance you place on them is at your own risk.

10. Mobile Application License

We grant you a revocable, non-exclusive, non-transferable, limited right to install and use the App on devices you own or control, strictly in accordance with these Terms. The following terms apply when you obtain the App from the Apple App Store (the “App Distributor”):

  • Your licence is limited to use of the App on an Apple device that you own or control, in accordance with the App Store’s usage rules.
  • We, not Apple, are responsible for providing any maintenance and support for the App, and for addressing any claims relating to the App. Apple has no obligation to furnish maintenance or support.
  • Apple is a third-party beneficiary of these Terms and may enforce them against you.
  • You represent that you are not located in a country subject to a US government embargo or designated as a “terrorist supporting” country, and that you are not listed on any US government list of prohibited or restricted parties.

11. Limitation of Liability

To the maximum extent permitted by Australian law, Foobar Creative is not liable for any loss or damage arising from your use of the App, including any reliance on AI-generated content, data loss, or third-party service outages.

12. Indemnification

You agree to defend, indemnify, and hold harmless Foobar Creative and its officers, agents, and employees from any loss, liability, claim, or demand (including reasonable legal fees) arising from your use of the App, your breach of these Terms, or your violation of the rights of a third party.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes are posted constitutes acceptance of the updated Terms. We’ll update the “Last updated” date above when changes are made.

14. Governing Law

These Terms are governed by the laws of South Australia, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of South Australia.
